Terms of Service

These Terms of Service (“Terms”) apply when you use the Coburger website, the Coburger customer app or the Coburger Driver app (together, the “Services”), operated by Coburger (“we”, “us”, “our”). By using the Services you agree to these Terms. If you do not agree, please do not use the Services.
Accounts
- You must provide accurate information when creating an account and keep your login details secure.
- You are responsible for activity that occurs under your account.
- The mobile app requires an account to place orders; guest checkout is available on the website.
- We may suspend or close accounts that breach these Terms or are used fraudulently.
Orders and payment
- All prices are shown in Australian dollars and include GST.
- Payment is processed at the time of ordering by Square, our payment provider. Pay-at-counter orders are paid in store.
- An order is accepted when the restaurant begins preparing it. We may cancel and refund an order if an item is unavailable or the order cannot be fulfilled.
- Scheduled orders are charged when placed and prepared at the scheduled time.
- Menu items, prices and availability may change without notice.
Refunds and cancellations
If something is wrong with your order, contact the restaurant or email hello@coburger.au as soon as possible. Refunds are issued at our discretion and processed back through Square to your original payment method. Nothing in these Terms limits your rights under the Australian Consumer Law.
Wallet credit and promo codes
- Store credit (including cashback, signup bonuses and wallet top-ups) can only be used to pay for orders through the Services. It is not legal tender and has no cash value, except that unused credit you have purchased as a top-up is refundable on request as required by law.
- Promo codes are subject to their stated conditions, may be limited in number or time, and may not be combinable with other offers.
- We may adjust or remove credit obtained through fraud, abuse or error.
Delivery
- Delivery is available in selected areas. You must provide a correct address and be contactable at the phone number given.
- Estimated delivery times are estimates only.
- If a delivery cannot be completed because of an incorrect address or you cannot be reached, the order may be treated as fulfilled.
Drivers (Coburger Driver app)
- Drivers must be approved by us before accepting deliveries, and must hold a valid driver licence and the right to work in Australia.
- Drivers are engaged as independent contractors, not employees.
- Delivery pay is calculated per delivery as shown in the app and paid out by us. Completing pickup verification (QR scan) is required to record a pickup.
- Drivers must comply with all road laws and handle food safely. We may suspend or remove drivers who breach these Terms.
Acceptable use
You must not misuse the Services — including placing fraudulent orders, abusing promotions or credit, attempting to gain unauthorised access, or interfering with the operation of the Services.
Liability
To the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the Services. Nothing in these Terms excludes rights or guarantees that cannot be excluded under the Australian Consumer Law.
Changes to these Terms
We may update these Terms from time to time. The latest version will always be available at this page, with the “last updated” date shown above. Continued use of the Services after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of Victoria, Australia.
